GENERAL UNDERSTANDING

In These Conditions

  • 'LCMSB' means Lady Cutler Melbourne Showboat, J.G.M Pty Ltd and the context requires, its employees or agents.
  • 'Passenger' means any person or persons on the cruise by virtue of this ticket.

HERE AT LADY CUTLER, WE VALUE THE HEALTH AND SAFETY OF OUR PATRONS. ALL OUR CRUISES WILL BE RUN ACCORDING TO THE CURRENT VICTORIAN GOVERNMENT HEALTH ADVICE. TO KEEP ALL PERSONS ONBOARD SAFE, WE WILL BE REQUIRING ALL OUR GUESTS AND STAFF TO BE FULLY VACCINATED. WE SINCERELY APPRECIATE YOUR UNDERSTANDING. WE WILL UPDATE OUR CONDITIONS OF ENTRY ONCE MORE RESTRICTIONS ARE EASED.

Pricing

All of the prices are in Australian Dollars (AUD) and subject to change without notice and liability.

Payment Method

We, LCMSB do accept any of the all following methods of payment. All payments to be finalised 14 days prior to the event date for Ticketed events and 28 Days for Private Events.

Bookings

A minimum non-refundable deposit of $2,000 for private cruises and 30% of the full amount for ticketing events shall be paid to confirm the booking date. Full payment and Dietary requirements must be made 14 days prior to the event date for Ticketed Events.

Full Payment for Private Events must be made 28 Days before the Event and all dietary requirements MUST be done 14 days before the event.

Upon payment of deposit, the customer will be deemed to have accepted the terms and conditions contained herein unless otherwise amended by agreement in writing.

Public Holiday Surcharge

Bookings for public holidays will occur extra charges. Please discuss with LCMSB sales staff to get a quote.

Minimum Ages Requirements

Guests must be 18 years for party events. Children (Under 12 years old) are permitted on Family, School, and Community events. Children are the responsibility of their parents at all times. LCMSB skipper and other crew members are not responsible for their care or safety. Life jackets are available for children and adults alike.

Cancellation of Event

Cruises will go out in wet weather. However, LCMSB reserves the right to cancel or postpone a cruise due to unforeseen circumstances. In any cancellations made by LCMSB management due to unforeseen circumstances, the customer will receive a full refund of the Deposit(s) or monies paid.

Transport

LCMSB will not cover customers' own transport costs to and from the pick up / drop off wharf in any circumstances.

Accessibility on Board

Certain types of light and manual wheelchairs can access the showboat upper deck through our stable vamp. Please note, toilets are no disabled toilet facilities. The toilets need to be accessed by stairs to the main deck.

Smoking Permission

Only on the lower level outside decks. We have installed ashtrays for your convenience.

Catering

Dietary requirements to be advised 14 days prior to the event through LCMSB management team for Ticketed Events and 28 Days for Private Events (info@melbourneshowboat.com.au). We endeavor to do our very best, but unfortunately cannot be held responsible for consumption/cross contamination with regards to allergies or dietary requirements.

Drinks

There is strictly no BYO drink on all LCMSB cruises to control the consumption of Alcohol onboard. Each adult guest in your group must purchase one drink package for themselves, and there is absolutely no sharing of the package benefits. There may be a charge if we find any sharing on the day. There will be plenty of water stations around the boat. Security may check your bags upon boarding. The bar closes 30 minutes prior to the event conclusion. LCMSB reserves the right to terminate the service of alcohol if patrons appear intoxicated and/or disembark patrons at the nearest wharf.


Safety Requirements for Travel and Disclaimer

All passengers participate in LCMSB cruises at their own risk. LCMSB does not accept any participating and contact us to discuss the specific requirement. LCMSB recommends that disabled persons seek medical advice before. Disabled passengers cruising aboard LCMSB do so at their own risk and the operator accepts no liability for any damage or injury caused. LCMSB reserves the right to refuse entry and/or to eject any guest for bad conduct, bad language, and/or damage to property at the discretion of the duty manager. If any passenger becomes intoxicated or unruly during the cruise, they will be dropped at the nearest wharf. No customer is to commit any act, or permit its employees, agents, or invitees to commit any act that is illegal offensive or in breach of any statute, by law, order, regulation, or other law.

LCMSB does not accept responsibility for damage to, or loss of customer property. Customer property must be removed no later than 2 hours after the conclusion of the function or by prior arrangement.

Photograph

LCMSB reserves the right to photograph events onboard for marketing and promotional purposes without notification, compensation, or payment.

Disclaimer

LCMSB's ability to meet its obligations under this agreement is subject to the intervention of matters outside its control including but not limited to industrial disputes, accidents, government restrictions, restrictions upon staff, food and beverages supplies, equipment failure, flooding, power failure, fire or any other unforeseen circumstances. LCMSB is not liable for any loss of profit and/or consequential damages, whether based on breach of contract, warranty, or otherwise.

Marine Insurance

LCMSB has all the correct certificates as per Transport Safety Victoria's requirements for operating as a Commercial Passenger carrying Vessel in Victoria Class 1E and 1D. We have a Certificate of Survey, (on display next to the bar on board) which is renewed every year and part of that is our Management Safety Plan, fire safety certificate, and the air receiver in the engine room.

Food: Every year LCMSB has Food Safety Handling, Management inspection, and on the certificate for Food Safety is current and of a high standard. LCMSB has also completed (above requirements) RSA's for every person's job working on the vessel. LCMSB also carry Work Cover for staff. Part of the Ship's Certificate of Survey is that we carry the required insurance, suitable for a vessel size of ours. Ship's insurance is divided into Hull and Public Liability. We carry a $500,000,000 USD Public Liability Policy. LCMSB also has an on premise Liquor License and a City of Melbourne Health Certificate for our Kitchen/Galley.

PRIVATE FUNCTION AGREEMENT

Booking

A minimum deposit of $2,000 OR 30% of the total Invoice (whichever is greater) is required to confirm bookings. The deposit is not refundable.

However, if your event is to be canceled due to a Covid lockdown or restrictions put in place by the State Government that will prevent your event from going ahead, we will offer you a full refund of your Invoice less $500 for administration costs. We shall not be liable for additional travel or accommodation expenses.

The full amount to be paid and the final number of guests to be confirmed 28 days prior to the event date. Unless alternative credit arrangements have been made in writing prior to commencement of the function, late payments shall incur a minimum penalty of 3% over and all other costs associated with collection payments.

Quote/Invoice

Quotes/Invoices for a private function will be valid for 7 days from the date issued. If a deposit is not paid by the client to confirm the date for the event after 7 days, the Quote/Invoice becomes invalid. LCMSB reserves the right to re-quote/re-invoice based on any changes to quote/invoice requirements.

Final Arrangement

The balance of the account is subject to variation in the event that guest numbers increase, otherwise, the total minimum cost specified in the agreement shall be paid; It is agreed that should the minimum number of guests decrease by 10 percent or more LCMSB reserves the right to vary the agreed price per person.

In the event that there is any change required to the menu selection, J.G.M Pty Ltd trading as Lady Cutler Melbourne Showboat (LCMSB) reserves the right to vary the agreed price charged per person.

Band and DJs

All Promoters, Bands, Musicians, and DJs are contracted on the basis that they are responsible to pay royalty fees to APRA and PPCA for music/songs/items they will play on our vessel.

J.G.M Pty Ltd trading as Lady Cutler Melbourne Showboat (LCMSB) will not be responsible for any fees that are to be paid to either organization.

Time and Duration

Exclusive private function embarkment and disembarking times are arranged at the time of booking. Extra cruising time will incur additional charges.

Safety and Security

LCMSB reserves the right to engage security guard protection services at the function, when and if it deems fit and necessary, for the safety and security of patrons, guests and staff, without any necessary consultation with the customer, by providing the customer 24 hours notice of its intention to do so (such notice to be given at the customer address as noted on the Contract herein, either by mail, facsimile or email and the customer agrees to pay the cost of any security guard protection services in addition to the agreed cost of the function on the same terms and conditions.

Set-up and Pack-up

LCMSB must be advised of any deliveries organised by the customer, prior to arrival. Bump in is 1 hour before boarding and bump out 1 hour after docking. LCMSB may charge the customer for any additional assistance provided in the setup or breakdown of the function.

Damages and Breakages

The customer is responsible for all breakages or damage caused by the customer and/or their guests including caused by decorations such as candle wax. LCMSB requires a minimum $1,000 cash damages/breakage bond ($1,500 for Dance Parties) to be handed, in an envelope, to the LCMSB cruise supervisor at the commencement of the cruise. Any damages incurred and deemed avoidable during the cruise will be discussed with the client and appropriate money will be paid to LCMSB to cover costs. Quotes for repair may be required. Some cleaning costs including the cleaning of vomit may be assessed as avoidable and part of damages. LCMSB recommends that the customer conducts a full inspection prior to the commencement and at the conclusion of their function. Refer to LCMSB for additional cleaning costs list.

Decoration

Decorations must not create an excessive mess and must not damage the vessel. Balloons, Ribbons, etc are allowed but not crepe streamers, no spider web - black or white as it stays on carpet and stains the furniture. We only allow you to use genuine Blu Tack and string to attach decorations. ABSOLUTELY NO STICKY TAPE.

BYO Catering

For your Private Function, you are more than welcome to nominate your own caterer or BYO. Please refer to the LCMSB BYO Catering package for pricing, event inclusion, and exclusion. All you need to do is sign the package agreement and disclaimer form, and leave the galley nice and clean as you found it! All of the LCMSB's equipment must remain on the vessel.

TICKETING EVENTS AGREEMENT

Group Booking

A 30% deposit for a group booking is required for all ticketing events shall be paid to confirm the booking date. Full payment must be made 14 days prior to the event date.

Refund, Cancellation and Date Transfer

All tickets for events at LCMS are not refundable unless we have cancelled the event. Please note that we will process any refunds to the credit card you have used for booking, or alternatively to your bank account upon receipt of your bank details. It may take up to 7 business days to process the refund. If purchased through an agent, please refer to the agent's terms and conditions.

In any cancellations made by LCMS management due to unforeseen circumstances, customers will receive a full refund of the Deposit or monies paid.

Please note that there will be a $20 p.p. extra date transfer charge within 28 days prior to the event date.

LCMS no longer accept any cancelations due to Covid. No changes can be made within 10 days prior to the cruise date and shall result in full loss of ticket at all times.

Unfortunately, refunds or transfers are not permitted due to a missed departure. For the enjoyment of all guests, LCMS cannot delay our departure for any late arrivals. We strongly recommend that you check travel/traffic conditions on the day of your event, in particular when there are special events (e.g. Marathon, parade, festivals etc) as these can often cause traffic delays.

Tickets may be used by other persons with LCMS Management knowledge.

We appreciate your understanding.

Cancellation

Minimum numbers do apply to LCMSB shared cruise events and we reserve the right to cancel or amend our services. Where this happens you will be offered the opportunity to reschedule or receive a refund. We shall not be liable for additional travel or accommodation expenses.

Food and BYO Cakes

Food is available on all cruises. Please check event details to find out if food is included or not. For ticketing events, guests are welcome to bring their own cakes for your group. We can keep the cakes in the cool room till you sing a birthday song :) Please bring your own disposable cutlery, crockery, candles etc.

Adult, Children, Infant and Family Rate

Adults are between the age of 13+ years old. Children are 5 - 12 years old. Infants are between 0 - 4 years old, permitted on board but must be noted when booking. Family is considered as 2 adults + 2 children aged 5 - 12 years old.

Tables and Seatings

Your table may be shared with another group if needed to facilitate seating of all booked guests on board a cruise.

Requests for tables of two and window seats will be taken into consideration on fine dining, but cannot be guaranteed LCMSB endeavour to meet all guest's wish lists.
